22ND LAL BAHADUR SHASTRI UNDER-21 WOMEN’S 4-NATION HOCKEY TOURNAMENT

As a part of belief and dedication towards society, our trust also supported the Indian National under-21 Women’s Hockey team, which had participated in the 4-Nation Lal Bahadur Shastri Hockey Tournament held in New Delhi in November 2011. New Zealand, Australia and Germany were the three other teams that had participated in the tournament.

We offered this sponsorship not only for the love of the game, which happens to be our national game but also to motivate the Hockey players to perform better on the field.

There goes a good proverb—”All work and no play makes Jack a dull boy“.

Games and sports is important for success in every walks of our life. Games and sports include all outdoor and indoor games and also athletics, and in Ancient Greece formed a principal part of education. Keeping in mind our objective of providing support and encouragement for young children to participate in sporting activities, the Trust provided a Basket Ball Board (KIPSTA B900) to the DDA Allottees Association, Qutab View Apartments for the general welfare of the children in the complex.

MEDICLAIM

It is fact that Health aid saves lives and allows children to develop mentally and physically, which will pay off within a generation. Studies show that these children become healthier adults who work more productively. If you’re arguing against that kind of aid, you’ve got to argue that saving lives doesn’t matter to economic growth, or that saving lives simply doesn’t matter. Keeping in mind our duty towards society, the Trust provided an amount of Rs. 45,000 towards the Hospital Bill of Mr. Hitesh, who was being treated for sudden cardiac arrest.

Sixth All-India Essay Writing Competition in celebration of

World Intellectual Property Day

We are extremely delighted to receive such an overwhelming response from students of various colleges from all over India who participated in the said essay completion based on the World IP Day theme – Innovation: Improving Lives. This year, the underlying idea behind observing the World IP Day is to explore how innovation is making our lives healthier, safer, and more comfortable by turning problems into progress. The epoch-making changes that have been undergone by the world in the past was given birth to by the ordinary people who innovate extraordinary things for the better. Their innovations take myriad forms, from the mundane to the seemingly miraculous. Innovation is a human force that knows no limits which turns problems into progress pushing the boundaries of possibility, creating unprecedented new capabilities. 26th April only celebrates the relentless efforts made by the human community for a better and more prosperous tomorrow.

India being a cornucopia of knowledge, capabilities and skill has left no stone unturned in protecting its creativity. In the recent times Indian Judiciary has delivered such judgments in the sphere of Intellectual Property which apart from expanding its scope in India have also been exemplary worldwide.

Last year saw many significant IP developments, for instance the most awaited National IPR Policy, was approved by the Union Cabinet and made public by the Department of Industrial Policy and Promotion on May 12, 2016, that laid down the future roadmap for Intellectual Property Protection and Management in India. In terms of IPR awareness, 2016 was laden with one government initiative after the other. The year began with the launch of the Start-Up India: Stand-Up India campaign which was launched on January 16, 2016. The campaign is an action plan aimed at promoting bank financing fir start-up ventures to boost entrepreneurship and encourage Start-Ups with job creation. The policy hopes to restrict the role of states in the policy domain and to get rid of the license raj and hindrances like land permissions, foreign investment proposal, environmental clearances, etc. To further facilitate a culture of innovation, the Office of the Controller General of Patents, Designs and Trademarks (hereinafter referred to as the ‘CGPDTM’) released the ‘Scheme for Facilitating Start-ups Intellectual Property Protection (hereinafter referred to as ‘SIPP’). The major objective of the scheme is to protect and promote Intellectual Property Rights awareness for startups and to encourage creativity and innovation amongst them by the appointment of IP facilitators. As an incentive, the start-ups shall not have to pay any kind of fee for seeking services from the facilitators. Instead, the facilitators shall directly be paid by the Central Government through the office of the CGPDTM. The Courts also rendered some noteworthy judgments and observations like in the DU Photocopy case, the Prius Trademarks Infringement case, the green light given to Biocon by the Delhi High Court to continue to market the breast cancer drug, Traztuzumab.

We however look forward to more such milestones by the Indian Judiciary which strikes a balance between creativity and public interest.

In addition, on the occasion of World IP Day Mrs. MaryKay Loss Carlson, the Charge d’affaires at the US Embassy, New Delhi states that, ‘with its robust economic growth, youthful population, and growing influence around the world, modern India is at a consequential moment in history. There is a growing sense that across this large, diverse country, India’s innovative spirit is awakening.’

2nd ALL INDIA ESSAY COMPETITION ON THE OCCASION OF

WORLD  INTELLECTUAL PROPERTY DAY- APRIL 26, 2012

On this day of World Intellectual Property Day, Vidya Darshan Rana Charitable Trust in collaboration with S.S. Rana & Co. is pleased to announce the result of Script it! Second All India Essay writing Competition.

We were extremely delighted to receive overwhelming response from students of various colleges from all over India who participated in the essay competition based on the World IP Day theme -Creativity the next Generation which essentially aims to highlight the shape of things that the human creativity is going to offer to mankind in future. Creativity is no doubt one of the most significant factors which led to the evolution of mankind in the past and similarly in future would lead to a next generation which would explore the unseen creations of technology, science and intellectualism.

India being a cornucopia of knowledge, capabilities and skill has left no stone unturned in protecting its creativity. In the recent times Indian Judiciary has delivered such judgements in the sphere of Intellectual Property which apart from expanding its scope in India have also been exemplary worldwide. In this regard the recent judgement delivered by the Supreme Court in Novartis Case and India’s first compulsory license granted to Natco can be aptly referred to.

The judgement passed by the Apex Court in the Novartis case received unparalleled media attention and extraordinary remarks from scholars and thinkers worldwide. Arvind Subramanium, Senior Fellow at the Peterson Institute for International Economics in his article India’s Disputed Ruling on Pharmaceuticals and Patents remarked that “other developing countries could be emboldened by the Indian example”. Thus, the Indian Judiciary has proved its mettle internationally in the domain of intellectual property by re-affirming its tougher patenting system where patents should be given “sparingly only for genuine innovations where the public benefit clearly exceeds the monopoly cost”. Similarly IPAB’s ruling in favour of local generic drug manufacturer Natco is an important milestone in the history of Patent in India as it marks a clear victory for generic manufacturers and also for patients who could not afford high priced life saving drug.

With third rank in terms of volume of production and fourteenth in terms of value, Indian pharmaceutical sector is recognized as the leading global player in international market. Despite of this India has a large unmet domestic demand for critical medicines. The prevalence of cancer is estimated to be about 205 million people, with about 8,00,000 new infections every year and 5,50,000 death occurring each year due to cancer. Considering that generic medicines accounts for more than 90 percent of the drug sales IPAB’s and Supreme Court’s decisions on pharma patents sure has farfetched consequences. It may lead to lowering of drug prices of the patented drug or better availability, but may also prove to be a major setback for the drug discovery and development programs in India and abroad and as a deterrent factor for innovators and MNCs that are contemplating investment in intellectual property in India.

We however look forward to more such milestones by the Indian Judiciary which strikes a balance between creativity and public interest.

On the occasion of World IP Day, Mr. Chaitanya Prasad, the Controller General of Patents, Designs and Trademarks greeted all officials, and those engaged in some way or other in IP creation, protection and utilization of IP in India. In his message the CG has said that “Indian Intellectual Property Office has tried its best to contribute to the maximum possible extent for the development of IP, under the modernization project which was implemented in 9th, 10th and 11th five year plans and has been continued in 12th plan also.”

Mr. Prasad further stated that over the years, there has been a steady growth in filing of IP applications and that creation of additional manpower to remove backlog, computerization and IT- enablement, reengineering of IP-procedures, electronic filing of patent and trade mark applications, efficient online search facilities, updation of IP-database, updated IPO website to provide up-to-date information on IP are some of the achievements of modernization project. He concluded by stating that IPO has achieved a distinct mile stone in joining Madrid Protocol for International Registration of Trademarks early this month and is also hopeful of starting the functions of IPO as International Searching Authority (ISA) and International Preliminary Examining Authority (IPEA) this year.

Script it! - The Essay Competition

The winner of the competition is Ms. Prachi Dilip Patil from Symbiosis Law School, Pune. Ms. Patil in her essay delivered her thoughts on Comparative Advertisement. An extract from her essay is reproduced below:

“Advertising is a small word but it is a whole world in itself. May be a marketer or a consumer, nobody can escape from the influence of advertising. Advertising has affected and is still affecting the life of all of us. In simple terms, advertising is defined as a paid, mediated presentation of information about services, products, or ideas with the specific goal of informing, persuading and reminding the target market about the company's offerings. Visual images constitute much corporate communication about products, economic performance and social responsibility, and also inform governmental efforts to create positive attitudes for citizens, consumers and organizations. Comparative Advertisement is new type and special advertisement which plays a very important role in modern commodity society. Comparative Advertisement is basically two types i.e. Direct and Indirect. In India comparative advertising is rampant; ironically one has to accede to the fact that its laws are very bleak and superficial in India"

We also invite Ms. Prachi to author an article in any of the forthcoming issues of the IPConnect.

Second Prize goes to: Sayantani Dutta from Kalinga Institute of Industrial Technology, Bhubaneswar, Odisha.

Third Prize goes to: Sagar Kothari from I.L.S. Law College, Pune, Maharashtra.

Other commendable entries were that of Gaurav Pant from G.B. Pant University of Agriculture and Technology and of Laxmi Prasad Boda from IIMC Collage, Hyderabad

Our hearty congratulations to all the winners and participants of  Script it!. The prize money and certificates are being forwarded to them.

World IP Day – First All India Essay Writing Competition

As announced in our Issue No. 15, Vidya Darshan Rana Charitable Trust in collaboration with S.S. Rana & Co. organized the First All India Essay writing Competition on the occasion of Intellectual Property Day. Several entries were received from colleges across India. We were overwhelmed with the response and would like to take this opportunity to thank everyone for the participation. Like they say “The most important thing is not to win but to take part!”, but again there has to be a winner. So without much ado, the names of winners are as follows:

First Prize goes to: Anil Sebastian from National Law School of India University, Bangalore

Anil deliberated on the Compulsory Licensing of Patented Drugs in India. A paragraph of his essay is presented below:

“…When the law confers upon an entity certain legal rights, it is usually because there is understood to be a public interest in the recognition of that right. Intellectual Property Rights are no exception to this general principle. Particularly with respect to inventors and innovators, these rights are awarded so as to reward them for their efforts, and to encourage them to do more of the same in the future. After all, the creation of more such intellectual property is seen to be of value to the public at large. However, there may be situations when the public interest in fact demands that these Intellectual Property Rights be restricted. The expected benefit to the public from the creation of more intellectual property often turns out to be a false hope. In the case of patented, life-saving drugs, this is most commonly because the price that the public needs to pay to gain access to the product is unaffordable. It is in such peculiar situations that the law seeks to reorient itself with the help of tools such as compulsory licensing…”

We also invite Anil Sebastian to author an article in any of the forthcoming issues of the IPConnect.

Second Prize goes to: Deepakar Livingston. P. from I.L.S. Law College, Pune

Third Prize goes to: Sayali Kanitkar and Pragati Deulkar from I.L.S. Law College, Pune

Other commendable entries were of Blessy B Mathew, Neha Wadhwa (from Rajiv Gandhi Technological University, Bhopal) and of Prashant Kshirsagar.

Our hearty congratulation to all the winners and participants. The prize money and certificates are being forwarded to them.
